Important Reminder for Landlords: Section 21 Deadline Approaching

If you served a valid Section 21 notice before 1 May 2026, you may still be able to start possession proceedings under the previous rules. However, there is a crucial deadline:

31 July 2026 – Final date to submit a possession claim to the court.

If court proceedings are not issued by this date, or if the notice is found to be invalid, the Section 21 notice will expire. The tenancy will continue as a periodic tenancy, and any future possession action will need to be pursued under the new Section 8 process.

What does this mean for landlords?

Under the new system, landlords must provide a specific legal ground for possession, such as:

  • Rent arrears
  • Anti-social behaviour
  • Breach of tenancy agreement
  • Intention to sell the property

Supporting evidence will be required, making accurate record-keeping and compliance more important than ever.
